I agree to release Eagle Ultimate Fitness from all liability relating to injuries that may occur due to equipment malfunctions and/or improper exercise techniques. By purchasing this membership, I agree to hold Eagle Ultimate Fitness entirely free from any liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence. I also acknowledge the risks involved in exercising. These include but are not limited to muscle strain, fractures, abrasions, concussions, and joint damage. I swear that I am participating voluntarily, and that all risks have been made clear to me. Additionally, I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in this activity. By checking this box, I forfeit all right to bring a lawsuit against Eagle Ultimate Fitness for any reason. In return, I will receive access to the club's facilities. I will also make every effort to obey safety precautions as listed in writing and as explained to me verbally. I will ask for clarification when needed.

I understand that this authorization will remain in effect until I cancel it in writing, and I agree to notify Eagle Ultimate Fitness in writing of any changes in my account information or termination of this authorization at least 15 days prior to the next billing date. In order to complete the cancellation process, an email request must be submitted to transform@eagleultimatefitness.com. If the payment dates fall on a weekend or holiday, I understand that the payments may be executed on the next business day. For ACH debits to my checking/savings account, I understand that because these are electronic transactions, these funds may be withdrawn from my account as soon as the periodic transaction dates. In the case of an ACH Transaction being rejected for Non Sufficient Funds (NSF) I understand that Eagle Ultimate Fitness may at its discretion attempt to process the charge again within 30 days, and agree to an additional charge for each attempt returned NSF which will be initiated as a separate transaction from the authorized recurring payment. I acknowledge that the origination of ACH transactions to my account must comply with the provisions of U.S. law.  I certify that I am an authorized user of this credit card/bank account and will not dispute these scheduled transactions with my bank or credit card company; so long as the transactions correspond to the terms indicated in this authorization form. I understand that membership pricing may be automatically adjusted for inflation. As part of having an active membership, I agree to never allow anyone else to use my gym access at any time. I agree to never let in someone who does not have an active membership at Eagle Ultimate Fitness. I will not allow non-members to access the gym without managements permission. If I am found guilty of doing any of these things, I agree to pay a $100 fee per person, per offense.
